Legislative and regulatory amendment proposals

Under article 18 of the law of 30 September 1986, the CSA is invited, as part of its annual report, to suggest "legislative or regulatory amendments it deems necessary to reflect technological, economic, social, and cultural change in the broadcasting industry's business."

In view of the events of last year and the insight they provided, as well as actions already initiated by the Conseil under its renewed membership, the Conseil's Board Members have deemed it desirable that a series of draft legislative amendments and one regulatory draft amendment be put forward.

. 1 – Provide the CSA with more extensive management authority over radioelectric frequencies under its jurisdiction.

. 2 – Give the CSA ex ante regulation authority over the pay-TV market.

. 3 – Improve conditions for the broadcasting by Internet service providers of local television channels.

. 4 – Provide for the registration (déclaration) with the CSA of on-demand audiovisual media services editors.

. 5 – Include the defense of women's rights to the CSA's charges.

. 6 – Provide for participation by the CSA in the drafting and monitoring of public broadcasting companies' contrats d’objectifs et de moyens (COM) (objectives and means legal agreements).

. 7 – Repeal the "compensatory channels" rule (règle des "canaux compensatoires) in DTT.
